These Terms of Service ("Terms") govern your access to and use of GymSaaS (the "Service"), provided by GymSaaS Inc. ("GymSaaS", "we", "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the gym or studio business you represent.
You must provide accurate information when creating a GymSaaS account and are responsible for maintaining the confidentiality of your login credentials and API keys. You are responsible for all activity that occurs under your account, including actions taken by staff members you invite.
Paid plans are billed in advance on a recurring basis (monthly or annually, depending on the plan you select) through our payment processor, Stripe. Prices are shown in the currency configured for your account. You authorize us to charge your payment method for all fees due, including charges initiated by your members for memberships and class packs.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.
You agree not to use the Service to store or transmit unlawful content, to misrepresent your identity, to attempt to gain unauthorized access to other tenants' data, or to interfere with the operation of the Service, including through excessive API usage beyond published rate limits.
As a gym or studio using GymSaaS, you are responsible for obtaining any consents required to store your members' personal information in the Service and for your own compliance with applicable data protection laws. See our Privacy Policy for how GymSaaS processes data on your behalf.
GymSaaS and its licensors retain all rights, title, and interest in the Service, including its software, design, and trademarks. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay applicable fees, or if required to comply with the law. Upon termination, your right to use the Service ceases immediately; certain data export options remain available for a limited period as described in our documentation.
The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, GymSaaS will not be liable for indirect, incidental, or consequential damages arising from your use of the Service.
We may update these Terms from time to time. If we make material changes, we will notify account owners by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
